MEMBERSHIP TERMS & CONDITIONS FINANCIAL COMMITMENT & BILLING - Membership requires a six (6) month minimum commitment. By enrolling, you agree to the full six-month financial obligation regardless of usage, cancellation, or service availability. - Priority Membership: $99/month for six (6) months. Elite Membership: $349/month for six (6) months. - Monthly dues are billed automatically to the card on file each month on your enrollment date. - The monthly fee is charged whether or not any membership benefits are redeemed that billing cycle. - If a payment is declined, reversed, disputed, or fails to process, you remain financially responsible for the full outstanding balance. Parlour FL reserves the right to (a) suspend benefits, (b) charge the card on file, and/or (c) invoice you for all remaining amounts due. BIOPROGRAMMING RESTORATIVE BLOWDRY — BENEFIT RULES Priority Members: Your one (1) monthly Bioprogramming session is valid only in months where you book and complete at least one (1) qualifying Parlour service (color, extension maintenance, hair treatment, etc.) in the same billing cycle. Elite Members: Your three (3) monthly Bioprogramming sessions are valid only in months where you book and complete at least one (1) qualifying Parlour service in the same billing cycle. The qualifying service requirement is satisfied once per month regardless of how many sessions you redeem. - Bioprogramming sessions may not be redeemed as standalone visits. They must be paired with a qualifying service. - Unused sessions expire at the end of each billing cycle. They do not roll over and are not eligible for credit, refund, or exchange. - Bioprogramming benefits are non-transferable and may not be gifted, shared, or assigned. BOOKING & AVAILABILITY - All services must be booked in advance and are subject to availability. Parlour FL does not guarantee same-day or same-week appointments. - Failure to book or complete services due to scheduling conflicts, cancellations, or no-shows does not entitle you to a credit, refund, or rollover. CANCELLATION & RENEWAL - Early cancellation does not release you from the six (6) month financial obligation. All remaining dues are due and payable in full. - After the initial six-month term, membership renews month-to-month until canceled in writing with thirty (30) days' notice sent via email. Verbal cancellation requests will not be accepted. DISCOUNTS & PARTNER PORTFOLIO - Member discounts may not be combined with other promotions or offers unless expressly authorized in writing by Parlour FL. - Partner perks (The Tox, Wellthy Method, R3 Medhouse) are independently managed and subject to change without notice. Parlour FL is not responsible for third-party services, products, or disputes. LIMITATION OF LIABILITY - To the fullest extent permitted by law, Parlour FL, its owners, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from this Agreement or any membership benefits, including loss of use, loss of revenue, personal injury, or property damage. - Parlour FL's total liability shall not exceed the total dues paid by the Member in the three (3) months preceding any claim, regardless of the form or theory of action. HOLD HARMLESS - Member agrees to hold harmless Parlour FL, its owners, officers, employees, agents, contractors, and partners from and against any and all claims, demands, actions, losses, damages, costs, and expenses of any nature arising out of or in connection with Member's participation in any Parlour service, membership benefit, or related activity, including services rendered by third-party partners. This applies regardless of active or passive negligence of Parlour FL, except in cases of gross negligence or willful misconduct. INDEMNIFICATION - Member agrees to indemnify, defend, and hold harmless Parlour FL from any and all third-party claims, suits, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Member's breach of this Agreement; (b) misuse of any membership benefit; (c) any act or omission by Member on Parlour FL premises or in connection with any service; or (d) any claim brought by a third party as a result of Member's actions. Parlour FL reserves the right to assume control of any such defense at Member's expense. ASSUMPTION OF RISK & WAIVER OF CLAIMS - Member acknowledges that salon and beauty services, including Bioprogramming Restorative Blowdry treatments, involve inherent risks including sensitivity reactions, hair or scalp responses, and outcomes that may vary by individual. Member assumes full responsibility for disclosing any known allergies, sensitivities, medications, or conditions prior to each appointment. - By enrolling and receiving services, Member knowingly and voluntarily waives any and all claims, known or unknown, against Parlour FL arising from the ordinary performance of services under this membership, except in cases of gross negligence or willful misconduct. - Results from Bioprogramming Restorative Blowdry and other Parlour services are not guaranteed and may vary based on hair type, condition, and individual factors. No representations made by Parlour FL staff constitute a warranty of results. GOVERNING LAW - This Agreement is governed by the laws of the State of Florida. Unresolved disputes shall be settled through binding arbitration in Florida per the rules of the American Arbitration Association. GENERAL - This Agreement constitutes the entire agreement between Parlour FL and the Member and supersedes all prior communications. - If any provision is found invalid or unenforceable, all remaining provisions continue in full force. - Parlour FL's failure to enforce any provision does not constitute a waiver of that right. - This Agreement may not be assigned or transferred by the Member.
